Queer Olympix sports competitions, which are planned to be held for the third time on 23-24-25 August 2019 and held in Heybeliada on 23 August, were banned with the decision of the District Governorate communicated to the organizers in Kalamış Park on the morning of 24 August. The reason for this ban decision was explained as "public order, prevention of crime, protection of general health and general morality" for the groups and individuals who will participate in the event, to prevent measures against provocations that may arise due to social sensitivities. SPoD and Queer Olympix teams, underlining that the reason for the administration is apathy and arbitrary, filed an annulment action against the ban decision. They pointed out that this prohibition decision violates the relevant laws, the Constitution, the ECtHR case law and the international convention.
This lawsuit, which was carried out by our association as a campaign case, was decided on 14.05.2020. As it was seen by the 5th Administrative Court of Istanbul that the concrete information and documents that demonstrate the basis of the ban on the activities were not submitted to the file by the Kadıköy district governorate, it was concluded that there was no lawfulness in the process regarding the banning of the said activity. Finally, it was announced by the court that the banning of Queer Olympix was illegal and that a ban was issued with allegations of aphasia provocation without any support. As SPoD and Queer Olympix, we inform LGBTI + the public and human rights defenders that we have won the lawsuit we filed against the illegal prohibition decision of the Kadıköy District Governorship, and that we will continue to fight with the arbitrary and unlawful decisions of the administration.
